Red Velvet suffered from a controversy before the release of its debut as the name Red Velvet is also the name of an Indie band around Hongik University that performed in 2013. While the indie band claimed an alleged “theft” of the name and lack of SM by not researching the name beforehand, it was confirmed that the band did not hold the copyright of the name so it does not qualify as a trademark and makes it impossible to claim rights for the name. Subsequently the band met with legal representatives of SM Entertainment and agreed to promote under the same name. In official statements SM said: “We had a meeting with the band Red Velvet and decided to keep the names as they are. We are now able to continue with Red Velvet’s debut schedule as planned, and we thank the band Red Velvet.”

SM Entertainment had to give official statements, “After questioning the director, we found that he simply uses a source of images for the collage, and there was no intention beyond that,” and added, “Based on the fact that SM was not able to realize it earlier, we will remove the material that caused the misunderstanding as soon as possible. We will make sure not to let this kind of thing happen in the future.” SM Entertainment decided to delete the MV and upload a re-edited version without the controversial scenes, which it released two days after the first music video.
